In the case of installment purchase, the controller of your personal data is Alza.sk s.r.o. with registered office at Sliačska 1/D, 831 02 Bratislava, Slovak Republic, Company ID No. 36562939, incorporated in the Companies Register kept by the Municipal Court of Bratislava III, Insert No. 35889/B as a tied financial agent of Home Credit Slovakia, a.s.

    We process personal data provided by you.

    More Information

    If you order goods or services from us, we need the information which is referred to as mandatory in the ordering process (in particular your first name and surname, and delivery address). If we did not have this information, we would not be able to deliver the goods. For the purposes of sale of goods or services, we also need your e-mail address, to which we shall send the order confirmation which serves as a confirmation of entering into the purchase agreement, as well as a copy of Terms and Conditions and Complaints Policy.

    You can also fill in optional information when ordering goods or services. Such information helps us perform the concluded purchase agreement more efficiently. For instance, if you fill in your telephone number, we can send you a notice of the goods delivery, etc. Providing optional information is voluntary.

    After the goods are delivered, you may get an e-mail message with the request to evaluate the goods purchased.

    If you contact us via the customer line or you send us a message, we shall also process your personal data stated in such communication.

    You may also provide us with some personal information before you order goods or services - for example, if you use the "Price Watch" feature, we will ask for your email address so that we can send you an email when goods are available or when goods are available at the price you have specified. Other services like the Best Price Guarantee work in a similar manner.

    For some services (e.g. AlzaNeo or installment purchase), you may be asked to provide additional personal information such as your identification card or a copy of your identification card to verify your identity (either in person at store, or remotely), as well as to validate your financial capability to settle payment for the goods / pay the AlzaNeo membership fees.

    In case you purchase an electronic book (or other electronic content such as journals) from our online shop, your first name and surname are displayed in the electronic book or journal. This is for the protection against illegal distribution and disclosure of the book you purchased.

    By filling in the optional information in your user profile, you may also provide us with other personal data, such as frequently used delivery addresses.

    In the event that you have opted to save your payment card details for the purpose of expediting future purchases on our online store, please be aware that we only possess partial information regarding your payment card, specifically the first and last several digits that are linked to your user account. If you desire to erase this data, kindly proceed to your user profile settings, navigate to the payment cards section, and then simply delete the payment card information (Account Settings > Payment Cards > Delete).

    If you make a payment using a credit card on your mobile phone, you will be directed to a secure payment gateway server. On the other hand, if you pay using a payment card on a computer, the communication between your device and the payment gateway server occurs through an iframe. This means that the payment gateway page will be displayed directly on our website, eliminating the need for redirection. Your payment card information is not transmitted to our company but instead sent directly to our payment gateway provider, using a secure transmission. Subsequently, the payment gateway provider will transmit the data to the relevant banking institution to facilitate the payment, all while maintaining a secure data transfer process.

    Personal Data Obtained Other Than Directly from You

    As part of joint marketing campaigns organised together with our business partners, we are entitled to process your personal data and we may combine them for the purposes of campaigns or of due performance of the agreement, as the case may be.

    In the event that your personal data is disclosed to a third party, we shall inform you in advance including informing you of the identity of such third party. If anyone discloses your personal data to us, you will have to be informed as well.

    Personal Data of Third Persons Provided by You

    In the event you provide us personal data of third persons, you are obliged to inform the person concerned and procure their consent to this Privacy Policy.

    There may be instances when you purchase goods from us, but prefer not to collect them or have a complaint about them. In this case, you have the option to assign authorised individuals in your user profile, who will be permitted to collect or claim the goods on your behalf. By doing so, you will be sharing their personal information with us.

    When you visit our website, we may collect certain information such the IP address, date and time of the visit to our website, information about your Internet browser, operating system, or language settings. We may also process information about your conduct on our website, such as links opened or goods displayed.

    If you access our website via a mobile phone or a similar device or through one of our mobile apps, we may also process information regarding your mobile device such as data about your phone, records of any apps crashes, and so on.

    How You Can Control Which Cookies We Will Process

    Camera Systems In Our Stores

    We automatically process camera recordings at our premises, including our self-service boxes, the so-called AlzaBoxes.

    Our stores and our self-service boxes, the so-called AlzaBoxes, are monitored by camera systems with online transmission and recording. The stores are equipped with cameras for the sake of prevention and also of investigation of potential illegal activities. The camera systems are operated by us, Alza.cz a.s.

    Mobile Version

    If you access our website from a phone, tablet, or a similar device, we will optimise it for the respective device. In such cases, we process your personal data similarly as we would if you were accessing it from a computer.

    You also have the option to download our free Alza app (e.g. Alza.cz, Alza.sk, etc.), which can simplify your shopping experience. Alternatively, you can download the Alza Media app, which is specifically designed for your electronic content purchased from our online store.

    If you grant the app permission to access location data, we may use your device's location to enhance your user experience and provide you with more relevant offers for goods and services (e.g. displaying the closest Alza store). Additionally, we may use the collected data to send you customised business communications. If you prefer not to receive such communications, you can easily opt-out of them entirely (see here). Similarly, personalised content may be presented to you directly on our website.     Why We Collect and Process Your Personal Data

    Your personal data is processed for the following reasons:

    • Purchase of goods and services: Our main purpose for processing your personal information is to ensure the efficient processing and timely delivery of your order. In the event of any complications, your personal data enables us to identify the appropriate individual to contact.
    • Customer care: In the event that you contact us with an inquiry or problem, it is necessary for us to process your personal data in order to provide a response or resolve the issue. Occasionally, we may also need to disclose your personal information to third parties such as shipping carriers or service centers.
    • User account: By providing personal information in your user profile, you gain access to several convenient features. For example, if you provide your telephone number, we can easily inform you of the expected delivery time of your order. You are able to modify the information you provide at any time, with the exception of your email address which serves as the primary means of accessing your user account.
    • Student programme: If you are a registered Alza user and hold an ISIC/ITIC card, you can register for Alza's student programme. In this case, we will store your name, surname and ISIC / ITIC card number and verify the validity of the card with each purchase in the ISIC database. You can stop this processing at any time by removing the card from your user account, in which case you will also be removed from the Alza student programme. However, we will retain information in our internal systems that a particular item was purchased with a student discount even after the card has been removed from your user account.
    • Marketing:
      • Electronic marketing: e-mail commercial communication is sent to you upon your consent. You can easily unsubscribe from our newsletters by adjusting your user profile settings, using our contact form, or calling our hotline at +421 2 5710 1800. If you create multiple user profiles with the same contact details (e.g. you have several accounts for different email addresses, but the phone number is the same on all accounts), it is not possible for technical reasons to perform unsubscribe from commercial messages for all user profiles based on automated processes. In this case, you need to contact us by phone or via the contact form to unsubscribe from receiving commercial messages for all user profiles..
      • Telemarketing: We make marketing calls for the purpose of offering our goods and services and related marketing communications. The legal grounds for the processing of your telephone number is either your consent or at least our legitimate interest in conventional direct marketing. You are entitled to raise an objection to such processing (see Contact Us > Other > Personal Data > Raising Objection) on our website.
      • You can receive a call from either our call centre staff and our robot.
      • Push notifications: The Alza and AlzaMedia mobile apps send so-called push notifications, i.e. short messages to your phone. You can easily configure the receipt of these notifications in your phone settings.
      • Marketing contests: In certain instances, the winner of a marketing contest may be photographed or filmed to increase transparency and credibility. We process personal data for this purpose based on our legitimate interest in promoting the attractiveness of our campaigns to other contestants. You have the right to object to this processing (see Contact Us > Other > Personal Data > Raising Objection for more details).
      • Retargeting: We may use retargeting techniques in some cases. If you do not wish to participate in retargeting, you may opt-out by clicking on the provided link and selecting the appropriate option
    • Improving our service: By analysing your order history and web behavior, we are able to offer you more relevant offers for additional goods, such as accessories for the products you have purchased. This allows us to display products that are directly relevant to your needs and interests in certain places. We may also use various tools such as A/B testing, Google Analytics, Facebook Analytics, and other similar techniques to optimise our website and personalised advertising on third-party websites.
    • Customer reviews of goods and services: after you purchase products or services from us, your may be asked to evaluate them. You may also post a review on your own initiative.
    • Call center: When you contact our call center (hotline), we will notify you beforehand that your call may be recorded. We use these recordings to assess the quality of service provided by our employees.
    • Exercise of rights and legal claims and control by public authorities: In certain cases, we may process your personal data to exercise our rights and legal claims, such as in the event of an outstanding claim against us. Additionally, we may need to process your personal data for inspections conducted by public authorities or other similarly compelling reasons.
    • Purchases with 0% VAT: For purchases with 0% VAT, we require the necessary documents, such as a certificate of registration for value added tax, a certified extract from the relevant register, and a trade license for the sole trader/entrepreneur to prevent unlawful activity.

    Conclusion and Performance of Agreement

    A large part of your personal data are needed by us in order to conclude the purchase agreement or another contract for goods and services you intend to purchase. After the agreement is concluded, we process your personal data in order to duly deliver the purchased goods, or to render the purchased services. Based on these legal grounds, we therefore primarily process billing and delivery data or, for example, your ISIC/ITIC card number if you are a member of Alza's student programme.

    Legitimate Interest

    We also use your personal data to provide you the relevant content, which may be of interest to you. On the grounds of legitimate interest, we process particular personal data, which is processed automatically, and cookies.

    We may also send you e-mails, so-called push notifications via mobile applications, and text messages, or call you on the same legal grounds. Processing of personal data related to monitoring via camera systems in our stores is based on the above-mentioned legal grounds as well.

    Due to the protection against illegal distribution and disclosure of the electronic book you purchased (or other electronic content), your first name, surname and address are displayed in the electronic book.

    To provide evidence of the recipient of goods rented through the Alza NEO service, we may take a photo of the individual collecting the goods.

    If you are registered as an authorised person for our corporate client, any transactions and interactions will be connected to that company. If you prefer not to have this association, please use a different email address than the one linked to the authorised person of the corporate client during the ordering process. Alternatively, you can request that we remove you from the authorised persons list.

    In case we process your personal data on these legal grounds, you are entitled to raise an objection to such processing (see Contact Us > Other > Personal Data > Raising Objection) on our website.

    Consent

    For the purposes of e-mail marketing and telemarketing, we process your personal data upon your consent. If you do not grant your consent and you are our customer, we can send you commercial newsletter (or give you telemarketing calls) even without your consent. In any case, you are entitled to reject such marketing communication simply by (a) adjusting your user profile settings, (b) using our contact form, or c) calling our hotline at +421 2 5710 1800 (when prompted by the robot, please choose "Other" as the reason for the call).

    We also ask for your consent if we need to verify your ability to pay for the goods delivered to you without your paying the full purchase price in advance (e.g. the Alza NEO service, when we loan you the selected device).

    We also ask for your consent when you sign, for example, the receipt of a claim using the Signosoft s.r.o. signpad, ID No.: 24307190. If you do not agree with the biometric signature using the signpad, you can sign the relevant document in a regular manner.

    If you grant your consent to the personal data processing, you are entitled to withdraw it at any time through our contact form (see Contact Us > Other > Personal Data > Other).

    Transfer of Personal Data to Third Parties

    Your personal data is transferred to third parties in the following cases:

    • Delivery of goods: The carrier chosen by you would not be able to deliver the goods ordered unless we transfer the information on where and to whom the goods should be delivered. This data is transferred to the carrier as entered in the order. Such data includes in particular your first name and surname, delivery address, telephone number where the carrier may contact you, and the amount to be paid on delivery, as the case may be. The carrier is only entitled to process the personal data we transfer for the purposes of delivery; the carrier must delete the personal data promptly afterwards.
    • Electronic content subscription: If you purchase a subscription to electronic content (magazines and other), we transfer your personal information to the relevant publisher, which is listed in the product description. Your personal data is subsequently processed by the publisher in accordance with the publisher's legal and privacy policy (e.g. if the publisher is Burda Praha s.r.o., Company ID No. 152 73 598, your data becomes subject to their privacy policy).
    • Delivery of goods stored for us by a contractual partner: If you order goods which are stored by our contractual partner, we have to transfer your personal data to this contractual partner who shall complete the order. Such data include sin particular your first name and surname, delivery address, telephone number where the carrier may contact you, and the amount to be paid on delivery, as the case may be. The contractual partner has to transfer the data to the carrier that shall deliver the goods; otherwise the carrier would not be able to make the delivery. The contractual partner that stores the goods for us and the carrier are only entitled to process the personal data we transfer to them for the purposes of the goods storage/delivery; they must delete the personal data promptly afterwards.
    • Delivery of goods via alzaExpres (including related services such as appliance installation): To improve the quality of our alzaExpres service, we use satisfaction surveys, which are sent out by our contractual partner ROUCEK Group s.r.o., Company registration number 01451561 ([email protected]).) For this purpose, we transfer your personal data consisting of the name, surname and delivery address to the above-mentioned partner.
    • Payment cards: Our company does not keep data about the payment cards you use to pay with us (unless it is explicitly stored, see the next paragraph below). Only the secure payment gateway Adyen and the relevant banking institutions have data about your payment cards. When you pay by payment card from your computer, communication with the payment gateway server is done via an iframe (i.e. the payment gateway page is displayed directly on our website without the need for further redirection).
    • If you have stored your payment card to speed up your future purchases on our online shop, we only keep basic information such as the first and last few digits of your payment card. To delete this data, visit your user profile settings and then simply delete the payment card data (Account Settings > Payment Cards > Delete).
    • Cryptocurrency payments: if you choose to pay with a cryptocurrency, we may share information about you and your purchase, such as the amount to be paid or your email address, with the cryptocurrency payment gateway.
    • Student programme: If you are registered for Alza's student programme, we confirm the authenticity of your ISIC/ITIC card for every purchase by checking the ISIC database. This database is maintained by the association CKM SYTS, ID No. 31768164. The information transmitted to CKM SYTS includes only your first name, last name, and card number. Your purchase details are not shared with CKM SYTS.
    • Alza NEO Service: As part of the rental of a device (e.g. phone, tablet, laptop), we will give you the device for temporary use for a fee, without you having to pay the purchase price for it. In this case, too, we therefore check your ability to pay the regular rental fee for the device. For this purpose, we pass on your personal data to Intrum Slovakia, s.r.o., ID No. 35831154, and LogiCall Slovensko, s.r.o.
    • Purchase from Alza via Aukro.cz:If you have an account registered with us and you make a purchase from us on Aukro.cz, your data will be added to your order through the Aukro.cz portal as part of our strategy to improve our services.
    • Commercial communication: In case we send commercial communication (e.g. via e-mail or text message) or if we use telemarketing, we may use a third party to distribute the messages or make phone calls. Such third party is bound by the obligation of confidentiality and is not allowed to use your personal data for any other purpose.
    • Reviews of products or services via Heureka.sk: When we send purchase evaluation surveys, we may provide your data, including your email address and information about the purchased goods or services, to Heureka Group a.s., the operator of the Heureka.sk portal.
    • Exercise of rights and legal claims, public authorities: To exercise our rights and legal claims (e.g. in the event that we have an overdue invoice in your name - if you do not pay for the rental of the device in the AlzaNEO program, if you do not pay for the goods you have received or if you otherwise enrich yourself at the expense of Alza), we may transfer your personal data to (i) collection agencies that assist us in collecting debts, (ii) companies that are interested in purchasing Alza's claim against you, (iii) the company that will purchase such claim (in the case of an assignment of claim), (iv) an attorney, or (v) a public authority. If we are obliged to transfer your personal data by virtue of law or upon a request by a public authority (e.g. police), we have to comply.
    • Claims: To handle your claim effectively and efficiently, the service centre may require additional information regarding the defect, its manifestations, or other relevant information. In this regard, we may provide the service centre handling the defective product with the details you have submitted on the complaint form, including your name, address, telephone number, and email address.
    • Camera records - AlzaBox environs: Alza enables delivery to AlzaBoxes to selected contractual partners. In order to protect the property rights of these contractual partners, Alza may provide the partners with camera footage of the AlzaBox environs.
    • Companies in the Group: your personal data may be shared on the legal grounds of legitimate interest with subsidiaries of Alza.cz a.s., registered office at Prague 7, Jankovcova 1522/53, postcode 170 00, company identification No. 27082440, incorporated in the Companies Register kept by the Municipal Court in Prague, Section B, Insert 8573, namely with:
      • Alza.sk s. r. o., company identification No. 36 562 939, with its registered office at Sliačska 1D, Bratislava - Nové Mesto, postcode 831 02, incorporated in the Companies Register kept by the City Court in Bratislava III;
      • Alza.at GmbH, incorporated at the Provincial Court in Wien, file No. 468821v, with its registered office at Favoritenstraße 21, 1040 Wien;
      • Alza.de GmbH, incorporated at the District Court in Munich, file No. HRB 227361, with its registered office at Geigerstr. 2, Munich, Germany;
      • Alza.hu Kft, reg. No. 01-09-286873, with its registered office at 1137 Budapest, Róbert Károly krt 54-58;
    • whereas you are entitled to raise an objection thereto through our contact form (Other > Personal data).

    What Is the Period for Processing Your Personal Data?

    We shall process your personal data for the entire duration of the contractual relationship between you and us.

    In case your personal data processing is based on consent, your personal data shall be, in general, processed for 7 years or until such consent is withdrawn.

    In case you subscribe to commercial communication, your personal data shall be processed for 7 years or until you express your disapproval of such communication. You can easily express your disapproval by adjusting your user profile settings, using our contact form or calling our infoline at +421 2 5710 1800 (when prompted by the robot, please choose "Other" as the reason for the call).

    Please note that the personal data necessary for the due rendering of services or for the fulfillment of all our duties, ensuing either from the contract between us or from generally binding legal regulations have to be processed regardless of whether you granted your consent for the period set out in the relevant legal regulations and in compliance therewith (e.g. tax documents must be processed for at least 10 years).

    The data obtained through the user account or in a similar way are processed for the period of using our services and then usually for 5 years after cancellation. Basic identification data and the information why the user account was canceled or information which is a part of operational advance deposits are usually stored for the relevant period.

    Cookies: After 30 days, we delete cookies that track user behavior, but older data remains available in an anonymised form in Google Analytics.

    The recordings of phone calls from and to the call center are archived for a short period not exceeding 1 year, unless it is necessary for us to store them for a longer period due to a legitimate interest (e.g. suspicion of data misuse, fraud etc.).

    We typically store your camera recordings for a period of 90 days. However, in the event of illegal activity in the monitored area, we may contact the police and provide the relevant recordings to the appropriate authorities (police, court, etc.). In such a case, the recordings are not deleted after 90 days, but are kept for evidentiary purposes until the matter is legally concluded.

    CCTV footage records at AlzaBoxes are normally stored for 28 days.

    Personal Data Security

    Your personal data is safe with us. We have adopted adequate technical and organisational measures in order to prevent unauthorised access and misuse of your personal data.

    At Alza we are concerned about the protection of your personal data. Therefore we regularly check and improve our security. All communication between your device and our web servers is encrypted. Logins are hashed and your data is only stored on servers in secure data centers with limited, carefully controlled and audited access.

    We try to use such safety measures that provide sufficient security based on state-of-the-art technology. The safety measures adopted are regularly updated.

    This is why we use 2-step verification when you sign in to your user account.

    Password Security

    We do not have your passwords saved to our system or any database. We work with special calculated hash keys generated by the BCRYPT hash function with work factor/cost 12. This hash function is currently the most powerful and safest to use.

    Personal Data of Children Younger Than 16 Years of Age

    Our online store is not intended for children under 16 years of age. A person under the age of 16 may only use our online store if their legal representative (parent or guardian) gives their consent.

    What Are Your Rights Related to Personal Data Protection?

    In relation to your personal data, you have in particular the right to withdraw your consent to the processing of your personal data at any time, the right to correct or supplement your personal data, the right to request restriction of processing, the right to raise an objection to or a complaint of the processing of your personal data, the right to access your personal data, the right to request the transfer of your personal data, the right to be informed of a breach of security of your personal data and, under certain conditions, the right to the deletion of certain personal data we process about you ("the right to be forgotten").

    Changes and Amendments

    You control your personal data mainly through your user account (My Alza > Account Settings > My Account). Here you can delete or change the basic information about yourself and change the settings concerning commercial communication (or unsubscribe), etc.

    You can also contact us through the our contact form.

    Correction

    If you believe that the personal data we process about you is incorrect, you can contact us through this contact form. However, for the sake of expediting the correction of your personal data and your convenience, we recommend that you edit your personal data in your user profile personally.

    Access (Portability)

    You can ask us to send you an overview of your personal data. If you have an account with us, please log in and proceed as follows: My Alza > Account Settings > My Account > Basic Information. Then click the button that says "Request my personal data". If you do not have your user account with us, please contact us using this contact form.

    You also have the right to access the following information concerning your personal data:

    • What are the purposes of processing your personal information
    • What are the categories of the affected personal data
    • Who is the recipient of your personal data, besides you
    • What is the planned period of storage of your personal data
    • Whether you have the right to claim the correction or deletion, restriction of personal data processing or to raise an objection to such processing
    • Information on the source of the personal data in case we did not obtain it from you

    Deletion

    You may also request that we delete your data (however, this will not affect data on documents that we are required by law to keep, such as invoices or credit notes). If we need your personal data to establish, exercise, or defend our legal claims, your request may be refused (for example, if we have an outstanding claim against you or if there is an ongoing complaint procedure).

    Please note that payment card information is not stored by us when payment is made without saving the payment card, but by the payment gateway provider (a third party). Therefore, we cannot delete this data and you need to contact the payment gateway provider through which you made the payment (see chapter Transfer of Personal Data to Third Parties > Payment Cards > More Information). Only basic information about the payment card is stored in our company if you choose to save your payment card with us (see chapter Types of Data Processed > Personal Data Provided By You > More Information).

    Except in the cases mentioned above, you have the right to request deletion in the following cases:

    1. The personal data is not needed for the purposes for which it was being processed
    2. You have withdrawn your consent under which the data was processed and there is no further legal grounds for being processed
    3. You have objected to the processing of personal data and you believe that after assessing your objection, it will become clear that your interest in the particular situation prevails over ours
    4. The personal data has been processed unlawfully
    5. The deletion obligation is stipulated by a special legal regulation
    6. The personal data concerns a person under 16

    How to exercise your right to deletion? If you have an account with us, please log in and proceed as follows: My Alza > Account Settings > My Account > Basic Information. Then click on the button with the text "Request for deletion of personal data" and follow the displayed instructions. If you do not have a user account with us, please contact us using this contact form.

    Raising an Objection

    Certain personal data is processed on the grounds of our legitimate interest (see section “Legal Grounds for Processing of Personal Data”). In the case that you have concrete reasons, you are entitled to raise an objection to the processing of this personal data. The objection can be raised through the contact form.

    Restriction of Processing

    If (a) you dispute the accuracy of your personal data, (b) your personal data is being processed unlawfully, (c) we no longer need your personal data for processing purposes, but you need it for establishing, exercising, or defending legal claims, or (d) you have objected to processing pursuant to the preceding point, you have the right to request that we restrict the processing of your personal data.

    In such a case, we may only process your personal data with your consent (except for storing or backing up the relevant personal data).

    Lodging a Complaint

    If you believe that we are processing your personal data unlawfully, you also have the right to lodge a complaint with the relevant supervisory authority. The lead supervisory authority responsible for personal data processing matters within the Alza group is the Czech Office for Personal Data Protection.     These Privacy Policy Terms are valid and effective from October 16, 2023, and are available electronically on www.alza.sk and in the contact section of the mobile app, if applicable.
