Instant Product Replacement - General Terms & Conditions

The Instant Replacement service is offered by Alza.cz as an option for customers. In the event of a warranty defect, the claim will be resolved by simply replacing the faulty product.

I. Definition of Terms & Conditions

Instant Replacement

  • The Instant Replacement service consists in purchasing a guarantee of immediate resolution of the claim in the event of a warranty defect.
  • This service can be used at any time within the duration of the standard product warranty.
  • Only one of this service can be purchased for a given product.

Seller

Alza.cz a.s., Company ID Number 27082440, with registered office at Jankovcova 1522/53, 170 00 Prague 7, is a company registered in the Commercial Register kept by the Municipal Court in Prague, Section B, Insert 8573.

Buyer

is a natural or legal person who purchases products or uses services for his/her personal use or for the purpose of doing business with these products or services.

II. Purchase of the Instant Replacement Service Together With the Goods

  • Every buyer has the option to request the Instant Replacement service when purchasing goods.
  • The goods to which the option to purchase the Instant Replacement service applies are marked with the service option at the time of purchase.
  • The buyer shall pay the price of the service upon purchase of the goods covered by this warranty service.
  • The Instant Replacement service is explicitly indicated on the purchase receipt.
  • The Instant Replacement service prices are listed on www alza.cz.
  • By purchasing the service, the buyer agrees that in the event of a request for the service, the seller is entitled to resolve the complaint by replacing the goods with parametrically identical or better goods from the same or different manufacturer and at a price level that may be 5% higher or lower compared to the original price the buyer purchased the goods for.
  • The customer understands and agrees that if he or she purchases any goods with a deferred payment option for the purchase price offered by the seller and purchases this service at the same time as the goods, then in the event of early termination of the contract for the goods before the purchase price is paid in full, the seller shall not be obliged to refund the purchase price for this service to the customer. This restriction does not, of course, affect the consumer's statutory rights.

III. Additional Purchase of Instant Replacement Service

  • The service can be purchased within 14 days of the date of the taxable transaction (as shown on the tax receipt) at any of our stores.

IV. Instant Replacement Validity

  • The seller defines a defect in the goods for which Instant Replacement may be applied as a defect in the product if it has been used in accordance with the instructions for use and in a manner consistent with normal use of the product.
  • Immediate replacement does not apply to wear and tear caused by normal use of the product, as this reason is not recognised by the claims process.
  • The Instant Replacement service cannot be applied to goods with broken protective seals, information stickers, serial numbers, etc.
  • The Instant Replacement service does not apply to damage to goods caused by:
    • mechanical damage,
    • electrical surges (visibly burnt components or circuit boards),
    • use in conditions that do not correspond to the temperature, dustiness, humidity, chemical and mechanical influences of the environment as intended by the seller or the manufacturer,
    • improper installation, handling, operation or neglect,
    • if the goods or any part thereof have been damaged by a computer virus,
    • if the defect is manifested only by software for which the customer is unable to prove the legal means of acquisition, or was caused by use of unauthorised software and consumables,
    • the goods have been damaged by ignoring the weight limits or by use contrary to the conditions specified in the documentation or general policies,
    • unqualified tampering or alteration of parameters,
    • goods that have been modified by the customer (painting, bending, etc.), if the defect is the result of such modification,
    • an incorrectly performed BIOS or firmware upgrade,
    • natural elements or force majeure,
    • incorrect or defective software,
    • use of improper or non-original consumables, or for any damages resulting therefrom if such use is nonstandard and was not included in the enclosed instructions for use.
  • Instant Replacement does not apply to accessories, parts and extensions of the product, such as batteries, cables, headphones, light bulbs or adapters.
  • In order to use the Instant Replacement service, the buyer must deliver a copy of the purchase receipt confirming the purchase Instant Replacement service along with the claimed goods.
  • Instant Replacement can only be applied:
    • at any branch of Alza.cz,
    • by sending the defective goods to Alza.cz - reklamace, Prologis Park - Gate 70, Severní 255, 252 19 Chrášťany

V. How to Use the Service

  • The seller expressly informs the buyer that in order to fulfil the service, it may, depending on the stock, offer to solve the complaint by replacing it with a product of the same or better parameters from the same or different manufacturer and at a price level that may be 5% higher or lower compared to the original price the buyer purchased the goods for. The buyer agrees to this procedure by purchasing the service.
  • For the buyer who has purchased the Instant Replacement service, the seller guarantees:
    • instant replacement of the goods in the event of a manifestation of the stated or other warranty defect
    • the issue and payment of a credit note for the service in the event that appropriate goods are not in stock within 48 hours of the application,
    • delivery of the goods in the shortest possible time according to the method and place of claim by the seller:
      • Prompt collection is possible upon submitting a claim in person at Alza.cz, Jateční 33a, Prague 7 - Holešovice
      • Delivery within the next working day in case of submitting a claim in person at any Alza.cz branch
      • Delivery within three working days if the goods are sent by parcel to Alza.cz - Horní Počernice Logistics Centre P3 Park, Hall E Do Čertous 2759/4, 193 00 Praha 9
  • The number of possible submissions requesting a removal of defects during the Instant Replacement period is limited, so that the buyer can claim for Instant Replacement only three times during the warranty period of the goods.
  • The service is used up by issuing a credit note for goods with Instant Replacement.
  • In case of large household appliances, the Instant Replacement service is used up at the moment of delivery of the goods to the address Alza.cz - Claims Department, LCU Warehouse - Logistics Centre Úžice, Prologis park Úžice, Úžice 267, 277 45, not when the goods are handed over to the carrier by the buyer.


VI. Transfer of Service

  • The transfer of the validity of the Instant Replacement to a third party for the remaining period of its original validity is possible upon written notification of this change to the seller.
  • The Instant Replacement can also be transferred to another product of the same product category if the original product for which the Instant Replacement service was concluded has been replaced by a new one by the seller within the statutory warranty period according to the Civil Code. This change must also be notified in writing to the seller.

VII. Termination of Service

  • The Instant Replacement service may be terminated by the buyer if the seller substantially breaches the Terms of Service.
  • In the event of termination, the seller shall refund 100% of the amount paid by the customer for the service at the conclusion of the Terms of Service. Instant Replacement ends upon the end of the legal warranty period for the goods.
  • By issuing a credit note for goods with the Instant Replacement service, this service will end on the date of issue of the credit note.
  • In the event that a credit note is issued by the seller for goods under statutory warranty, the seller undertakes to refund the amount paid to the buyer for non-use of the Instant Exchange service.
  • In the event that the Seller is unable to provide the service (meaning a parameters-adequate or price-adequate replacement is not available in the warehouse spaces of Alza.cz), the seller undertakes to issue a credit note for the service in its full original value.
